general terms and conditions
quoting, payment and invoicing terms and conditions
- by making payment to an invoice issued by Ironwright of Dunmow ltd the buyer/customer agrees to the terms and conditions set out below.
- payment by bacs, card payment and cash are acceptable form of payment we do not accept cheque payments.
- payment must be received in the date/time scale stated on the invoice to ensure current availability and prices of the required goods or works.
- Ironwright of Dunmow ltd must be notified and delivery approved prior to any Goods and items being delivered to the workshop for restoration, bespoke works, or any other services.
- To ensure we achieved a high standard of safe productivity and efficiency in the workshop, the goods on arrival, will be inspected and a quote will be send to the buyer/customer to approve within 14 days unless stated otherwise. Once the approval has been confirmed by the buyer/customer a proforma invoice will be sent to the buyer/customer for payment. If the prospective works cannot be confirmed by the buyer/customer in the time frame given to ensure the works can be booked in at a reasonable time, the items will placed into storage at additional cost to the buyer/customer @ £10+vat per item per week or re collection will be required until the work details are fully confirmed. During this time Ironwright takes no responsibility for the items.
- Due to the nature of the works,material costs and availability – quotes and invoice pricing are valid for 7 days unless specified in the invoice, we also reserve the right to requote at any given time due to material or working cost increases during this time up to payment being received.
- unless specified on the invoice, all items purchased from Ironwright of Dunmow ltd are sold as seen or to the invoice requirements and are nonrefundable. If an item is found faulty, damaged, or not as specified in the invoice the issue will be looked at on a case-by-case basis. Some goods not manufactured directly by Ironwright of Dunmow ltd may contain manufacturer warranties not associated with Ironwright produced products and it is the buyer’s responsibility to ensure any manufacturer warranties are activated and details correct.
- Unless specified on the invoice Payment is required cleared prior to restoration, Bespoke work or alterations to existing items and are nonrefundable. By making payment to the terms of the invoice, the buyer agrees Ironwright of Dunmow ltd is not responsible for irreversible damages caused by the required works to said items.
- Ownership of any goods will not pass to the buyer until full payment has been received whether the item has been delivered, collected, or installed.
- All items and goods must be collected within 14 days of completion/purchase date unless stated otherwise prior to invoicing .There will be an 8% interest fee added to all overdue invoice after 30 days.
- The buyer/customer will be charged @ £10 +vat per item for storage and additional for delivery thereafter. If the goods additional charges are not paid and cleared within 90 days of completion/purchase of the goods, ownership will be passed to Ironwright of Dunmow ltd and or sent to auction and costs will be deducted from the outstanding charges. Legal proceedings and Enforcement may be issued to recover outstanding costs.
delivery/collection terms and conditions
- any item to be delivered either by post, courier, pallet or van etc will be at the buyers expense payable in advance and before any delivery being booked.
- Safe and Sufficient Unloading and parking for delivery should be made available prior to delivery directly outside the property or delivery location where possible and should be in accordance with local authority regulations.
- Any fine or parking fee caused by buyers inability to provide sufficient parking for the safe unloading will be at the buyer expense.
- Ironwright of dunmow ltd is not responsible and takes no responsibility for any damaged caused in loading, unloading, in transit and during storage.
- Unless agreed prior to otherwise, the delivery would be curb side only and buyer should have correct means to safely unload and transport items there on. There should be no assumption made the items will be carried /transported into a specified location other than immediate curb side/front of house location.
- In addition to the delivery charge, the buyer must pay on demand the storage, redelivery, insurance, charges and any other cost caused or associated by the buyer being unable to accept the purchased item on the delivery time or date provided or agreed.
- The Buyer shall inspect the goods immediately on the arrival/collection. Goods damaged in transit must be reported immediately to the driver and signed on delivery note ‘Damaged on arrival’. Please also take a photo before its removed and contact Ironwright immediately.
- If the delivery note is signed without the comment ‘Damaged on arrival’ and Ironwright not contacted immediately for evaluation of the situation – Ironwright of Dunmow ltd cannot be held responsible for damages thereafter.
- Ironwright is not responsible for any damaged caused to items that are collected from the workshop, or damage caused loading items collected from the workshop.
- Any item returned to Ironwright are at the buyer’s expense unless stated otherwise. Ironwright must be notified before any item is to be returned and accepted.
- Buyer must ensure they have adequate means of transport, storage and loading facilities and or personnel for any item collected from the workshop prior to collection and or delivery.
- due to the throated section, throated lintels are NOT structural supports, they should never be stacked, leaned against or any weight placed on them. The concrete material the throated lintels are made from can have or may produce small amounts of natural surface crazing commonly associated the curing process of concrete, these are not structurally voidable or accepted forms of product failure, if in doubt always contact Ironwright immediately on delivery or collection with any issues or questions. if a throated lintel is found to be inadequate by Ironwright a like for like item will be issued. Risk and return cost to any Goods to be returned remains with the Buyer until the Goods are delivered to or collected by the Seller on pre-approval.
- Throated lintels to be returned at the buyer’s expense undamaged unused and in perfect re sellable condition and approved by Ironwright of Dunmow ltd can be exchanged for goods of the same or less value of the item cost amount only not including and associated delivery costs. No refund will be offered for returned goods only credit on similar items of the same value or less on approval after inspection of the item.
Onsite, contract works, appointments, inspection visits and measuring.
- if a site visit is required prior to invoicing/quoting by prospecting buyers/customers a payment of £120 inc vat fee may be applied and an additional £2+vat per mile over the 50-mile radius of Ironwright workshop CM74LQ address required and cleared in advance of the appointment. This amount is non-refundable, but the fee of £120 inc vat will be credited to the final invoice if the buyer/customer proceeds with the works provided in the invoice by Ironwright
- onsite work, installation, removal, and delivery are by preapproval only and at additional cost and not included in the purchase price.
- the buyer/customer is responsible for ensuring the onsite working environment is to current health and safety requirements.
- Where applicable and on request Ironwright can produce a risk assessment for onsite works
- suitable access must be available to the general working area and minimum of 2m square clear where applicable in the immediate working area prior to arrival.
- the buyer/customer must ensure the working and surrounding area is adequately protected, any or all fixtures and fittings in the immediate working area are to be removed, protected, or covered prior to the works starting date, although great care will be taken to minimalize disruption to the surround areas, cleaning after the works is at the buyers/customer’s expense. Ironwright Is not responsible for any damages to items in the working environment not sufficiently covered, protected, or removed in the working environment.
- The buyer/customer should provide/discuss in advance with Ironwright data and information from other contactors works on site relevant too or that may affect/cause disruptions to the works provided by Ironwright
- In addition to safe availability of Power source and mains water supply, sufficient lighting must be available on site in and around the working area.
- Unless stated on the invoice or agreed by both parties prior to the agreed site works the buyer/customer should provide waste disposal facilities. There will be a waste disposal fee if this is not provided. hazardous waste and removal will need to be inspected and removed by the correct hazardous waste handling firm e.g. asbestos.
- If the pre-arranged appointment date/days are cancelled or postponed at short notice by the buyer/customer through no fault of Ironwright With in 3 days prior to the agreed dates the buyer/customer will be charged £225+vat a day for each day and tradesperson required for the work specified on the cancelled dates of that period.
- The buyer/customer should provide Safe and Sufficient Unloading and parking which includes parking permits and should be made available prior to arrival directly outside the property or location where possible and should be in accordance with local authority regulations.
- Any fine or parking fees caused by buyers’ inability to provide sufficient parking for the safe unloading and close access of vehicles to perform the works required during the onsite works will be at the buyer expense.
- For working at heights, if access is not safe or cannot be achieved buy ladder, the buyer will supply unless specified prior to production the specialist access machines (cherry picker) or scaffolding for working at hights in accordance with current working at heights and safety regulations. ladders are only for access not a suitable working platform.
- Although great care and professionalism will be always given, Ironwright takes no responsibility for damages caused due to ladder,access or temporary scaffold tower/platform to or on the building.
- It is the buyers/customers responsibility to ensure the fireplace is sufficiently protected during and after immediate installation of any fireplace where the fireplace is at risk of dust, moister, paint, general building environment or irreversible damage caused by neglect.
- Ironwright takes no responsibility for any damage that may occur during the removal process of fireplaces,chimneys flues or anything associated with the works prescribed in the invoice or quote .
Using Solid fuel, gas and other heat producing products and appliances
- There should be no unauthorized use of the solid fuel or gas fireplaces until the fireplaces have been fully commissioned and signed off as compliant either by building regulator or hetas approved fitter or gas engineers whichever is applicable to the appliance.
- Although Ironwright will supply where applicable and thoroughly explain the dos and don’ts of a working fireplace and heat producing products, It is the buyer/customer/users responsibility to fully familiarise themselves and understand the legal requirements, local building regulations, operational requirements, manufacturers requirements and guides but most importantly dangers of solid fuel, gas and any other heat producing fireplace and products. If you are unsure of how to safely use and maintain your fireplace or heat producing product do not use and seek professional advice prior to use. Never leave children, animals, or the fire itself unattended while in use.
- Ironwright advises all working fires are installed to the document J regulations, manufacturers requirements and are swept and checked on a regular basis.
